It's really not though. Heller was, apropos strict laws at the state level, pretty fucking toothless. The circuits have already agreed that a strict interpretation of Heller is fine, which basically means any law not passing a categorical ban on large classes of firearms in common usage will pass constitutional muster. The SCOTUS doesn't want to hear cases, they didn't hear Kolbe v. Hogan and I doubt they're going to want to hear a similar cluster fuck in the future. They're still not going to grant cert. without another justice change. Even if they did, I still doubt you would see a massive expansion of Heller.

Legislative was the only way to move forward, and that just flew out the door with this election.
