Possible Disability Discrimination?

He wouldn’t know to ask because of his cognitive deficiency. It doesn’t appear any accommodation was done for him or any kind of an action plan to assist him in his daily requirements of the job. No paperwork describing his quality of work was given to him.

I spoke with a manager after he was fired to see what was going on, she stated that “He refused to learn how to use the floor polisher.” , which my brother said they never showed him how to use that. He also weighs 85lbs and is 5ft tall and a floor polisher is extremely heavy. His primary roles was to sweep the store, clean the bathrooms and any spills. He had been in that new role for the past 4-5 years before new management came in back in October of 2019.

Before that he was pushing carts, but it was putting a lot of strain on his body and he wanted something inside. So he began that new role inside as a maintenance worker once a position opened up 4-5 years ago.

I know because of his disability, he wears his emotions on his sleeve and can become overwhelmed if the right accommodations are not met. The new management didn’t appear to treat him with the kind of respect or the patience that he deserved and needed.
