President Biden has indicated that he will nominate a black woman for the next SCOTUS opening. Regardless of intentions, can having race and gender as the first two qualifications be considered discriminatory? Why or why not?

When buying a car, I discriminate against pick up trucks because they don't fit my needs. That's not a bad thing. It's simply the result of picking one that fits my needs.

This comparison doesnt fit the issue though. You said it yourself, "I discriminate against pick up trucks because they dont fit my needs", yes...exactly...the capability a pick up truck provides is something that will not be useful to you, so therefore there is no reason to chose such a vehicle.

So, now that youve identified what you need in a car, what bearing does the color of the vehicle of your choice have of in capability? None, other than preference, because they are all built the same. As result discriminating based on color is not vad at all. However. With people we are not all built the same, and when you do something as ignorant as say "I only eant a black woman, or a white man, to fill this position", you completely eliminate potential to fill the position with the most capable person. I.e. there is no actual added value to discriminate between people based on color, and guven that people are all built differently what you end up with is an unnecessary hindrance in your ability to find the most capable person.

A more proper, and harmless way to discriminate that would be comparable to your car buying example would be if Biden said "the next person to fill this poisition will not have a degree in political science". THAT is harmless/productive discrimination because you are only accepting people based on their qualifications. The color of someones skin, or their gebder, has no bearing on their qualifications and is a bad/ineffective way to discriminate.

People should want the best person for any job, regardless of where they came from, the color of their skin, their gender, their height, their age, or any other physical attributes. Purposely discriminating based on any of those things is pretty fucking stupid, and a major step backwards no matter how you try to sell it.
