Property lease vs dwelling lease

Are you in a property with different tenants presumably with separate leases of their own?

Yes. We rent the upstairs of a house and there's a seperate lease for the basement tenants.

Are the balcony/grounds common areas to be enjoyed by all and you've essentially been given a licence to use these areas?

We have access to the balcony from our kitchen. There are stairs to the yard. He said "I'm just letting you use the balcony". The downstairs people moved in a year and a half after we did and they never have used or expressed wanting use of the balcony. The landlord has a small closet in the basement he uses for his own storage.

Or were they included in the definition of premises / property?

It was written by the landlord at the bottom of a page saying it's a dwelling lease and that the balcony and grounds are subject to being revoked with 24hr notice.

The reason for all this, he's renovating the balcony. We knew from the day we moved in that he was going to renovate the balcony. He never told us how long it would take until the day the construction started.when it started he said it would be max 2 weeks. This was at the beginning of April. We moved all of our stuff off of it and everything is either in the yard or inside the house. They tore it down and then we didn't see or hear anything from the landlord or the construction guys. We didn't know if they left or what. A month later more guys come and set up a porta potty. And build the stairs and base. There's no railings so it's still not useable. He still has no updated us what's happening. The building of what's there took 3 days. They buggered off. A month later we come to now and the landlord tells us it will be 1.5-2 months still. That he's paid the guys and there's nothing he can do.btheyll get here when they get here. Understandable. We were upset because he didn't update us at all what was happening. Especially because our babies room window is open over the balcony so we need to know these things for sound and naps.

This whole time, we stupidly assumed that the balcony was part of the rent. My SO and landlord got into a big verbal fight and then today he brings a copy of the lease (because he didn't give us one.. I thought he did... Apparently not.) And that's when he told us that we have a dwelling lease and only the inside living quarters were covered in the rent and he's letting us use the balcony. And that if we wanted we could change our lease to a property lease which would mean we'd take care of all the bills and handle the finding of the basement tenants and handling their rent.

I just wanted stuff cleared up because I couldn't find anything on Google about a dwelling lease or a property lease.
