Even that is still alleged which seems to clarify what’s going on a bit.

For whatever reason the law has sat on this case since 2015. No clue why. Could be lack of evidence, could be incompetence, could be back log of cases. As it stands to the law there has only been an uninvestigated complaint.

The person trying to get custody can’t really lose that Right based solely on a complaint (they could actually lose it for any reason the judge wants but at least from a “by the books” perspective), so as far as the court has to go off of this isn’t a rapist getting custody it’s just an estranged father.

The judge is to blame here but also the local police.
