Remember when a 12y/o girl and a former NFL player sued the feds over cannabis? They lost the first time, but they have appealed and will be going to court in less than a month!

This is not a good result. This case relies on the celebrity and/or compelling nature of the plaintiffs and raises no new theory as a route to federal de-scheduling that hasn’t been beat back a dozen times or more. We now have the most conservative scotus ever and this case has the possibility of setting bad precedent.

The route to change is de-regulation at the federal level by legislation. This is now possible with the balance of power we see today. These claims will be denied as they have been several other times. The court will refrain from “re-writing the law” on separation of powers grounds.
