It doesn't work like that because who gets to decide who's innocent and who's not? How do we know someone's not going to change later in life? The same case could be made for Oliver and the people he's killed. When Oliver was in Russia he killed that man in prison just because he was told to. When the guy was framed and put there by the bratva. More recently after Laurel was killed we know Oliver went back to killing others again.

Slade even said the mirakuru isn't just the only excuse. He was an assassin for hire before. And Slade had years to get that mirakuru out of his system. In court Slade would be still charged with involuntary manslaughter if a case for mirakuru could be made.

Merlyn would be charged even though he had his Redemption. Sara would be charged for working with an illegal organization that kill people (they have the word assassins in their name). Thea would be charged Roy would be charged the list goes on. Like I said it doesn't work like that because once you kill somebody you're guilty of killing that person whether or not the intention is that's where you get the different charges for murder like involuntary murder, voluntary murder, manslaughter, vehicular homicide, etc.
