They can and eventually will break into the phone somehow. They want Apple to do it because it's Apple's operating system, they know it best and could do it the fastest and easiest. Every time they want access to someone's device (likely a dead persons), they'll require a warrant, just like they would when breaking into someone's house (raids).

On to civil forfeiture. Civil forfeiture helps me because it allows the government to get funding from the criminals they take from (and the probably small amount of civilians they take from). I don't have to fund them as much with my tax dollars.
