In some places it might as well be.

I was smoking outside a bar in Boston a year or so ago and saw a group of friends walking up, one of whom was wearing a MAGA hat. The other friends stopped before they got to the door and pleaded with the friend wearing the MAGA hat to take it off. He refused.

Sure enough, the bouncer would not let him in wearing the hat "for his own safety" and he got huffy and said they wouldn't drink somewhere that didn't respect his 1st Amendment rights. His friends were like, "Dude this is the fourth place, just take the hat off."

They got in an argument and he ended up storming off alone. Fragile thing definitely got jumped if he kept that hat on walking alone.
