Second Circuit reverses conviction for accused ‘cannibal cop’ | fantasy is not a crime

My understanding of your position is that it acceptable to talk about how you're going to commit a serious crime against a real person that you really could very easily commit that crime against, as long as you make sure that the government doesn't find out that you're doing that talking, and as long as you don't actually commit that crime.

Do you have a problem with people talking about BDSM online? It's assault, isn't it? Do you have a problem with people talking about first-person shooters online? That's murder. People get a pass to talk about all sorts of things that would be wildly unacceptable to do (especially without consent, in the case of BDSM). So what's your problem with this? Is it that you personally disapprove of it?

If someone has fantasies about kidnapping someone they know, raping them, killing them, and eating them, but never communicates those fantasies, and never acts on them, should that person get help? My current understanding is that you would say no, they shouldn't. Is that correct?

Actually, my answer is, "that depends." If it's causing the person or people around them distress, then yes. If they're afraid they might hurt someone, absolutely. If they get caught doing something real that might actually indicate they're acting on their fantasies - like building a crime kit - then yes. If they're otherwise healthy and they're just having weird fantasies in the presence of consenting people, no, they don't need help.
