I never said he was charged by the judge, I said he never should have been charged in the first place and the judge never should have allowed it and tossed it out to begin with. He knew Brendan had an IQ below 70. Beyond his confessions that weren't admissible, there is ZERO evidence that ties Brendan to any of it.

yes it absolutely is his place to chastise a prosecutor for misconduct, it's his fucking job, why do you think the charge of prosecutorial misconduct exists in the first place? You think the tooth fairy levels that charge? I can't even begin to fathom why you would think this isn't the judge's job.

That charge is leveled by other prosecutors. The judge can recommend that an attorney's misconduct be examined by the entity responsible for disciplining attorneys for violations of the professionalism rules, but unless the prosecutorial misconduct has been directly leveled at the court (e.g. lying to the court), the judge generally wouldn't be in a position in involve himself.

If it weren't his job the charge and the option to charge a prosecutor with it wouldn't exist.

It would be his job to hear a case charging prosecutorial misconduct, but that's not what was happening here.

It's called Due Process.

The judge is in charge of ensure SA, the criminal defendant, has due process. The way a court deals with a tainted jury pool is allowing the defense to move for a change of venue and to challenge jurors. Again, the defense opted not to do those things. Steven wasn't deprived of due process, he simply chose not to use those particular processes even though they were options.

As for why Denny shouldn't have applied, because they weren't directly accusing anyone. Denny wasn't meant to be applied the way it was in this case. The defense just wanted to be able to say it was possible somebody else could have done it, the judge said no

That is not even remotely what happened. SA absolutely wanted to "directly accuse" others, and was still free after the Denny ruling "to say it was possible somebody else could have done it." SA simply wasn't allowed to argue that the people he specifically named had done it, but he was free to argue that someone else had done it without naming names. It's exactly the situation in which Denny is supposed to apply.

This doesn't make any sense since Steven was allowed to argue the murder was done by someone else. He was also allowed to argue that it was committed by Brendan Dassey.
