Your position is akin to arguing that you couldn't be speeding because your car has breaks and you'd use them if you went too fast. Unless you actually used them when needed the fact they were a potential option has zero impact on the situation. Much like saying they could have closed the potential bar has no weight without knowing if they did actually close.

We don't know if there was a bar. We don't know if it was closed, and we don't know if op actually asked and was refused water.

It may indeed still be irrelevant. Or, it may be proof the business was operating illegally at the time that op was there.
