Yes if T-mobile has a program that says if you meet X requirements have a video stream and apply we will not meter your data and your bandwidth for video will be throttled to 480p.

That program breaks net neutrality.

In a world where the internet is neutral there is no applying to a corporation to get your data unmetered, there is no throttling applied to you because you are a video service.

It doesn't matter if you can turn off the program because the program is what breaks net neutrality.

Lets say you run a car factory and suddenly your told you now get 50 kilowatts of electricity free!

Awesome says the 10 kilowatt and 50 kilowatt truck factories and they go around spreading how awesome the program is because they get free electricity to build their trucks. But what about 100 kilowatt truck factory? Well he pays for everything he uses.

We have guys on the street telling people this system isn't fair.

But if you use 50 or less kilowatts of power everyone can get free electricity how is it not fair?

Well the people point out that the 100 kilowatt factory pays for all his electricity it isn't fair.

Well they say 100 kilowatt electricity uses to much electricity so he turned off the free electricity if he used 50 or less he would apply it is fair they say.

Well the people say what about the car factories using 30 kilowatts? The program didn't care about the cars. All the power they use they have to pay for.

10 kilowatt and 50 kilowatt were so focused on how they got free power because they used less than 100 kilowatt that they completely forgot truck factories aren't the only factories that exist. That is what makes it not fair.

The 10 and 50 kilowatt truck factories are like the audio and video streaming, they can get these wonderful exemptions.

The 100 kilowatts truck factory is the video streaming services above 480p

The car factories are everything else that uses your internet, your web browsing, your games, your reading.
