Sorry but you misunderstand the Tennessee vs garner case law. It is unconstitutional to use deadly force against a fleeing suspect unless they pose an imminent threat to the officer or others. Running with a gun (even after burglarizing an empty vehicle) is not necessarily enough to be considered imminent danger. Now if the suspect had shot the gun, pointed it at someone, or was running into a crowded area or occupied residence then one may be able to articulate a deadly threat.

However, it appears the suspect is just fleeing down an alleyway, so I believe the officer will be hard pressed to articulate a deadly threat. Now, I wasnt the one responding to the call, so I don't have all of the facts, but based on this short video I would say it doesn't look like a good shoot.
