As a general rule, federal judges must impose a minimum term of imprisonment upon defendants convicted of various controlled substance (drug) offenses and drug-related offenses.

And simple possession is not one of those offenses. One year is the maximum, not the minimum. Read the statute.

By law a minimum of 1 year, so a minimum of 1 year it is. Perhaps there is a few cases where a minimum was not applied but the report gives the impression that the majority of cases have the minimum in effect.

Most cases of simple possession don't even get prosecuted federally, if they even are at all.
