Thoughts on rape through lying?

I think his appeal will be successful, otherwise they're really opening up Pandora's box here.

As a general point, I don't really see how a person can consent to sex twice, then withdraw that consent after the fact.

As another general point, I think everyone should have a little bit of scepticism when they are meeting a new partner, because people lie all the time, they lie about how many sexual partners they've had, they lie about their age, their job, their salary, their age, their height, their marital status and about things even more serious like whether they are taking contraceptives. We all know this so it would perhaps be prudent to take some precautions here.

Now whether some of these things should be specifically legislated against, that's another question, but whatever the answer is I don't think these lies followed by sex should equate to 'rape'.
