I had never delved that deeply into the theory behind no-proof DUI convictions before, and doing a quick read of the page I sent you shows that there's plenty of interesting information out there on the topic. I've never been subjected to nor had the opportunity to refuse a breathalyzer, but I still remember my gym teacher/driving instructor pounding it into our heads back in the 80s that you will be treated exactly the same as if you blew a .08 or higher. Now how convictions appear on your record with or without a test may vary state to state, but if the results are the same, I'm not interested in finding out!

Perhaps someone should write an app that will tell you whether or not you should refuse a breathalyzer. You configure it with your gender, age and body characteristics. Then you log your drinks on a night out. Click a big "I got pulled over!" button and the app will use your location and logged drink details to determine what to suggest. As both you and the page I sent you suggests, in some cases it may be beneficial to refuse vs take the test, and this app may be able to predict the outcome. It may also do a push notification to a local DUI lawyer to get the ball rolling before you're cuffed and stuffed. Of course, it will need to SECURELY store and destroy your data as that can and will most definitely be used against you in a court of law. Also the legalese around the app would have to be about ten pages long to protect the author. It's not impossible, though.

A little bit of research into each state's laws and a little bit of app hacking and you can get something up and running within a week. Start small, though, with just a couple of states and slowly add more as you complete your research. I may be half kidding but I bet there's a market for it.
