Ya, I honestly have no idea what the above commenters are trying to say. You can't just go along with it because you're uncomfortable without ever saying no and then say you've been raped.

You might assume that every person out there is some killer who will snap if you don't do everything they say without question, but that doesn't mean you've preemptively established criminal intent for every person on Earth. If your friend asks you to hang out and you accept only because you're uncomfortable, you have not been kidnapped. If a homeless guy asks you for change and you give it to him only because you feel scared, you have not been robbed. Rape is not a misunderstanding, it is a crime. A crime is not a crime until it has been committed (or at least attempted).

Now, of course, if you're putting a lot of pressure on a girl who says no, then you keep twisting the screws to try to get her to relent, then that's different, but to say that you don't have to even make the other person aware that they are crossing the line would set a dangerous precedent, because now you have to convict people of things that cannot possibly be proven. Even if you had a video and audio of the entire encounter, with signed contract from immediately before and after the act stating that the whole thing was consensual, all it would take is a simple "I only complied because I was scared" and then what happens? You could never prove or disprove that, so how can you send a person to jail over it? It would take telepathy to reasonably settle a case like that, and if telepathy was real we wouldn't have to bother with the trial in the first place.
