Towed Car from private lot without authorization? Maryland

I do not think that the law you are citing is applicable. In another section of the code, it defines "Parking Lot":

(a) "Parking lot" defined. -- In this subtitle, "parking lot" means a privately owned facility consisting of 3 or more spaces for motor vehicle parking that is:

(1) Accessible to the general public; and

(2) Intended by the owner of the facility to be used primarily by the owner's customers, clientele, residents, lessees, or guests.

The lot that you were towed from does not sound like it is accessible to the general public. In order to park there, your girlfriend needed a pass.

The distinction, here, being that since the lot is restricted to only residents, the rules of you parking there would be articulated in your lease. And, to your girlfriend when given her pass.

If you want to see if the car was illegally towed, you would want to look to your lease, or the contract your girlfriend would have agreed to when they gave her the pass.
