TPP: ISPs will hand over copyright infringer details

No need to go to court, just a boilerroom full of phonebanks and minimum wage workers reading from a script and a machine that will make millions forever.

By no means am I a fan of the TPP, or these wide net 'copyright infringement' firms. But did you even read the article?

Firstly, there would still be a need to go to court. The article of the TPP that is being cited in the article states:

"Each party shall provide procedures, whether judicial or administrative, in accordance with that party's legal system, and consistent with principles of due process and privacy, that enable a copyright owner that has made a legally sufficient claim of copyright infringement to obtain expeditiously from an internet service provider information in the provider's possession identifying the alleged infringer, in cases in which that information is sought for the purpose of protecting or enforcing that copyright,"

The current model in Canada already reflects this, copyright holders can go to court to obtain a persons identity if they wish to seek civil action against them.

Existing Canadian legislation already prohibits these practices, and has fairly tight regulations on what kind of demand letters can be sent, the content and context of those letters and who is authorized to send and act on behalf of them.

There is enough to opposed the TPP over, blatantly making up false claims doesn't lend any credence to the legitimate concerns associated with this legislation.
