True. It is a misdemeanor. If your car is the type that has a... finicky speedometer (one that is always off by at least one) you can get it tested by a place that can then notarized form saying you are good, it is your car that is dumb and it wipes away the charges.

Source: I did that. My car actually did have this issue and I was caught going 81 when I thought it was 79 on cruise control. The cop was nice and friendly and told me about this. Went to a place near where I went to college, got the test, they said 'yep, that is off', got the notarized form, sent that baby in and the charges were dropped. I still had to pay the fines, though.
