When did I say anything about deserving? The issue is that who's at fault doesn't matter if you're dead. If you get run over by a car and die, the guy should get what's coming for him, but no matter what happens the cops can't resurect you. Whether or not the guy is legally at fault no longer matters, all that matters is you're dead and its all over.

If you want an example that's not lethal, how about car accidents. Sure if a guy rams into you he's at fault and he would have to pay for damages, but even if you're not at fault, you still pay by being late to wherever you're going, and have to deal with the pain of losing access to your car. As such its still in your best interest to not get hit, either perform evasive maneuvers if possible, or drive more defensively to begin with. There's more to situations then who's at fault.
