What changes to space law would we need to colonize Mars?

I can't help but to think that this discussion is not including enough the notion that it could be a direct democracy 2.0.

I'll try to explain what I mean through a thought experiment. Small disclaimer is that I've never studied social or political sciences and its not part of my 9to5 so there might be some views that can feel like bigotry... but I assure you its most likely just plain ignorance :)

As a starting point I will take what I see as Musk two key points in the answer.

  1. It should be harder to put a law/policy in to place then it would be to take it out. Example: 60% to put and 40% to take out.

  2. Laws are not everlasting. Sunset period exists, after which the law/policy has to be revoted with a large number in to extension.

Lets try to fast forward and ignore the first couple of expedition's and its crew because direct democracy amongst scientists is irrelevant in this thought experiment.

Try to think of a situation where the colony on Mars is just past Dunbar's number (100 - 250). Imagine people are diverse enough in their skill sets, level of expertise and beliefs and have access to a wikipedia type (peer reviewed) knowledge base where you can find fully transparent information about a certain topic up for debate. Would people try to educate themselves on that topic to the level where they feel competent enough in it to vote or would they gravitate more to some type of representative (or liquid even) democracy?

Now lets try to jump a bit more in to the future to the population of 8-10 mil people. Lets assume there is some form of governance but its more Switzerland like just to accommodate for the policy making/law enforcement/judicial ecosystem but still has a high degree of direct democracy. Would the 60-40 Musk idea function or would we need some form of constitution set of laws that would protect the rights of minorities that didn't manage to convince 40% of people that they find something damaging/harmful/offensive?
