"The town council of Palm Beach should be ashamed of itself," Mr Trump said. "They're fining me for putting up the American flag. This is probably a first in United States history."

"They want me to pay a daily fee for the privilege to fly the American flag, or preferably they want me to rip it down. I'm just not going to do it."

Mr Trump, who hosts the business reality show The Apprentice, has refused to take down the flag despite the town's decision to fine him $1,250 (£620) for every day that it remains up.

Instead, he is suing Palm Beach for $25 million (£12 million), claiming that it is selectively enforcing its codes and that flying the flag is a constitutionally-protected expression of free speech.

Mr Trump, noting that his flag is the same dimension as the one that flies over the Capitol in Washington, did not ask for a permit for the flagpole, but sent a letter to officials on the day it was erected, saying: "Obviously, permits are not necessary to put up an American flag".

Mr Trump says that if he wins the lawsuit, he wants any money awarded to go to servicemen returning from Iraq.

Even Mr Trump's Palm Beach butler, Tony Senecal, has admitted that the flag was probably visible "halfway from Cuba". He said of the flag: "It's Donald Trump. He's a really red, white and blue American".
