Will the new wage rule stand in court?

I think it makes it harder for international students to get in. The change is against what it is trying to achieve because it doesn't consider factors like age and education, which help determine potential. For example, with this system, a 40 year old on $130K/year will get a H1-B over a 21 year old fresh grad offered $100K/year graduating from a US university. Even though the 21 year old has far more potential, can work for significantly more years and is far more likely to integrate, has already contributed enormous amounts to the economy through tuition fees and doesn't have the added burden of kids or family. Correct me if I am wrong but from what I have read, this does seem to be the case.
