Sure, they can deny the claim, but they won't get away with listing the AP as the reason for the denied claim if they have no proof one was ever installed. Cobb admits that Subaru can likely see when the last ECU reset happened, but that also happens if you disconnect the battery, so it's not a valid reason to deny a claim unless you take the car in with the AP clearly visible.
