Workers can’t be fired for off-the-clock cannabis use in California under new law signed by Newsom.

Lol I was a former Workers’ Compensation Adjuster for the US’ largest HR outsourcing firm. We were captive, so we ate the losses. We’d good every claim possible, as any insurance carrier would.

It can vary by state, but typically you need to prove the employee was intoxicated at the time of injury, and that their intoxication was the proximate cause of their injury.

Alcohol is easy, as we can take blood alcohol tests.

Marijuana was always hard to void, since many states have legal or medical marijuana laws. And for most other states, the company would’ve had to establish itself as an official Drug Free workplace for them to legally withhold medical and indemnity benefits.

So it sounds like it’s you that’s never dealt with a W/C claim, or if you did, you let your employer screw you over due to ignorance of the law.
