I was worried about being banned for getting it early and probably spent a good hour looking for an answer to if getting the apk before it's released would get you banned or not.
I don't have the link to the thread I saw - but a developer did post on reddit saying that they aren't going to be punishing anyone as long as they are using the proper apk (the servers have to be capable of running at capacity anyway). The apk I got - and hopefully the rest of you got was from one of two approved sources (apk mirrors that the Google play store itself uses).

Any kind of bug has to be accepted by everyone if it's not even released here officially and where it IS released is as a beta. I'll look again tomorrow for the post I'm referencing if people are worried... but with people playing and already paying it doesn't make sense to ban anyone when they could have easily turned off the ingress nodes based on GPS.

It's just a good marketing combo of supply/demand "you can't get it" mixed up with what is sure to be a good mainstream media bonanza of free outlandish publicity in the days to come.
