No it wouldn't. The test is literally subjective and there is no 'reasonable person' test as found in other legislation, it simply comes down to ones own definition of grossly which is so subjective it is ridiculous. Basically, the police decide whether a crime has been committed at all or not based on their subjective definition, one police officer may find cock jokes 'grossly offensive' and the next not. If that specific officer does not find the joke offensive it isn't a crime, if another sees it and does, it is a crime.

It's like a law being passed saying people aren't allowed to walk 'too fast', what the hell is 'too fast' and is that not completely subjective?
