Inspired by Hakimi, will this work in India?

I did something similar. My family home was in everyone's name. Me, my father, my mom, my brother.

After my father passed away, we moved town. I am nri. We sold the family home. Now the new house is only in my mom's name. Me and my brother going through divorce. As others mentioned, she can't claim half in India. She can only demand what she wants for mutual divorce.

Being NRI, I flied for divorce in canada. If I had property or kids here, shit would have been very messy. 50:50.

Most of my 20s were gone in paying of loans and I had like 40k saved up. I said to my lawyer that I am ready to get rid of half of it to finish this divorce. He said we don't have to disclose our account balance unless spouse asks to. Only assets have to be declared in divorce. Spouse didn't claim anything in divorce. She thought that not showing up to court will not grant me divorce like in India. It worked against her. Divorce was granted without any hassles.
