Depending on how loud that was I think doing that in someone’s ear like that could be considered battery. Guy is looking at at least temporary hearing damage. At the very least it’s safe to assume that noise probably hurt like hell.

Justified use of force probably depends on whether the guy let him go right after the video ended.

He didn’t slam the kid, wasn’t wailing on him, and didn’t appear to actually be choking him. I would say that was an appropriate reaction, but again, NAL.

Of course, if he continued to pin the kid down after recognizing that he wasn’t a threat, I wouldn’t say it’s justified.

If I’m wrong, I’d love to hear a different perspective.
