This is a tough one for sure, and I could be wrong, without seeing the tail and wings well. The geography does fit Swainson's better, but it wouldn't be impossible for the WT to be that far north in TX.

I was going more off the fact that the dark face and bib seem to both be the same very dark color more like a WT on this bird, while in Swainson's it tends to be more reddish-brown on the upper chest and darker on the head and face when the chest is this light. (Maybe play with the color density on your app and see if you can sort this out).

The White Tail tends to have wing tips that look longer than the tail when folded, kinda like here. But the Swainson's also has fairly long folded wing tips.

Also, the White Tail tends to have a longer light patch in the midline down the throat all the way to the chest, while on the Swainsons the light throat usually doesn't continue down to the chest. But with the amount of feather variation each can have, I sure could be wrong.

If you don't have it already, might want to check out the free app Raptor ID, it gives you a little more info and more photos than Merlin Bird ID or Audubon app. It's also better for flying ID for raptors.
