Given the Supreme Court brief, it is highly unlikely there will ever be a cap on NIL. If they open up for limits on NIL for one profession or class of workers, it is then opened up for all. If there is anything the Federalist society judges are against, it is treating any group differently under the law. To them, this is no different than MJ having a shoe deal with Nike. Given the progressive judges see this as a workers rights issue, you lose again.

The moment the NCAA tries to throw a cap on there, there will be an injunction in place until it hits the courts. When it does hit SCOTUS, you need to flip 5 of 9 judges that were in support of players getting paid. Flipping a few of them, you could probably do that. Flipping 5, that would be laughable.
