If I could help you, when its a fan art you clearly dont own the rights BUT you can use the image IF you have realised the pic/drawing/... and ONLY if you dont use the pic for your own image, promotion, etc. and you dont damaged the licence image (nintendo is really active againt this situation and the copyright law: they close the eyes for free fan-art and minor work like fanzines, but if you use a Zelda/Mario/Donkey Kong for porn you could have a very bad time: a well knowed model creator for SFM have a bad experience: for example, his site was shut downed)

fan-arts sales is another problem. You dont have the right to sale it normally (comissions are not legal too but its different, its a special command between you and a customer,you dont really have to claim you create it for the sale but the customer need to pay you). Fanzines can be produced and sale for others reasons, like special situation (a charity ) or just pretent to caricature the original. Each time however you need to disclaim the right of property and you need to name the originals creators.

goodies agin could be considered totally as fan art and not caricature. somes companies arent happies to see this (Nintendo again). Blizzard act weirdly against this.
