You know, in all fairness I actually downloaded the Penal Code to check the legitimate wording. Part 7, chapters 5 and 6 is where people should look if they want to check. Part 7 Chapter 5 concerns "Immoral and Disgraceful Actions" and Part 7 Chapter 6 concerns "Debauchery, Dissipation and Fornication"
Some of the wording may be open to some serious interpretation flexibility if someone wanted to get a certain result.
Article 296, Point 3 and 4:
In addition, Article 285: Whoever copulates with a male over sixteen years of age WITHOUT (i.e. consensually) compulsion, duress or ruse shall be punished with imprisonment for a term up to seven years.
Article 281: Whoever copulates with a female over sixteen WITHOUT (i.e. consensually) compulsion, duress or ruse shall be punished with imprisonment for a term up to seven years.
And in addition to Article 281, Article 282: Whoever copulates with a female over sixteen WITHOUT (again, consensually) compulsion, duress or ruse knowing that he is prohibited to marry her for permanent or temporary reasons shall be punished with imprisonment for a term not exceeding fifteen years shall apply to any person. The same penalty shall apply to a female who accepts such copulation knowing that it is prohibited.
Now while all of these can probably be argued in certain ways in court in order to make your case, they all carry jail terms, NOT a death penalty.
Except Sharia Law is a main source of Qatari legislation according to Qatar's constitution. Sharia is applied to laws pertaining to family law, inheritance, and several criminal acts (including ADULTRY, robbery and murder).
And under Sharia, homosexual acts are forbidden in traditional Islamic jurisprudence and are liable to different punishments, including flogging, stoning and the death penalty.
Seems like there is a lot of room to wiggle about withing their penal code.
