Article 50 Challenge: the Government’s Defence

Jolyon Maugham is a tax QC who is one of the leading voices behind the challenge which is seeking a declaration from the High Court that the government cannot, as a matter of constitutional law, invoke Article 50 without passing it through Parliament first (which would be challenging as most MPs are pro-Remain and anti-economic chaos).

In July, the High Court made an order stating that the government's written reasons for opposing the legal challenge (which it had submitted to the court) were confidential and to disclose them would be contempt of court. This was to stop the proceedings being affected by the amount of abuse/publicity they would inevitably attract.

This document is an application to have that order amended and allow the publication of the government's reasons, in addition to a few other things such as their skeleton arguments in a redacted form.

The Court allowed this, and so now you can see the reasons and the applicant's skeleton argument.
