both NARA and Trump had previously referred to the recently recovered
documents as “official presidential records”, placing them
clearly under the purview of the US government – not Trump.
Legal experts point out that Trump made the mistake of giving
public statements on Feb. 10 saying that the materials were
presidential records and would be displayed in his presidential
library, “to help formally preserve the Trump Legacy”. So, given
Trump’s acknowledgement that the materials were designated as
presidential records under the PRA, it would also be a violation to
leave office with them under the law.
