ELI5: Why do so many people in the USA get arrested for resisting arrest? Surely you need to be arrested for something else first in order to resist.

No, its called discretion. The one last thing police officers have left which hasnt been absolutely destroyed by this country.

Ever get pulled over for something, but just issued a warning? DISCRETION.

Ever get stopped on the street for something stupid but given a warning? DISCRETION.

Ever maybe commit a crime but cooperated and got cut loose with just a summons or less charges? DISCRETION.

Reddit tries to make it seem like the world is black and white and that the answers to every scenario are the same. They are not, the world is not. If you are driving with your entire family and get stopped for something stupid and are nice and pleasant with the officer, and maybe have your business card or your work ID, we can try to ID you that way. But, if you are this absolute 21st century asshole who thinks its cool to be a dick from minute 1 then maybe that discretion will not work in your favor. And even if you are a complete dick to the cop, it still doesnt mean you are going to be brought back to the precinct to get ID'd because that is up to that cops discretion.

99% of the time you are getting arrested for not having your drivers license on you while driving, but we need to figure out who you are. People lie to us all day, every day. If I think someone may be lying to me, or their story keeps changing and doesnt make sense and they don't have ID, there is no way in hell I am taking their word for it. Maybe I'm reading the guy wrong and he's telling the truth, but we are going to go back to the precinct to find out who you are and if I am wrong you will get a summons from the precinct and be on your way. The only time someone will get arrested for not having their drivers license will be if there is more to it than that, like they are suspended or wanted.
