NJ Child Support Guidance

Time with your children is taken into consideration with NJ child support. The person who has them less than 50% of the time usually pays CS based off of the time spent plus the parents incomes, but not in all cases….His visitation is already court ordered but she doesn’t abide by it. She literally said “I’m not gonna listen to this” right after court. He’s taken her to court multiple times over finances and visitation. She moved and refuses to give him their address (which he also has a right to know in NJ unless there’s extenuating circumstances, which there aren’t). He’s had to go to her moms house to try to see his kid on multiple occasions. He is a decent dad and tries his best but financially he does not help me at all due to the whole ordeal, and she makes it very difficult for him to be a present father. Like I said she just wants the money but not him to actually be involved. Now I need the help for daycare; it’s about $750 more a month for the full week and I can’t afford more than $200 tops (and that’s with making sacrifices, like getting the rid of cable). He said he really can’t give anything and he would have to let bills go unpaid. I told him I was gonna take him to court and he agreed but were trying to figure out if the judge would automatically put in a modification request on his behalf, or if he has to file another one. I know they recommend it in these situations, but not sure if a court to court referral is typical.
