He has too much conscience (remember, he's not a hardened criminal, he's a taxi driver), so he just can't pull the trigger and execute a crying girl in a bath tub. So he lets her go with a promise that she'll leave the city. This has consequences later.")

Basically, both scenes show that Tom is too much of a good heart for a gangster. It has absolutely nothing to do with feminism.
