eBay Picture Policy Question

TLDR: Do you think a camera date stamp on photos violates ebay picture policies? Should I risk it?

Longer explanation:
I haven’t sold on EBay in years, so I’ve been researching how to do things. The EBay picture policy is pretty clear:

Photos with added text, artwork or marketing material are not allowed.

I’ve been researching potential competition. So, I’m curious how sellers like this get away with this. Their main photo has text all over any bare photo space that isn’t product. Doesn’t that violate eBay policy?

One thing I’ve noticed is they’re all sellers, with various user names, with the same practice, and sometimes duplicate names/policies, with China-made products sold from US locations, and with huge feedback numbers.
