I was charged with anticipatory obstruction of justice for deleting files of of my computer among other charges. I had deleted them the day after I got in. At that point there was no Federal investigation initiated for at least a few days. Under traditional Obstruction of Justice. Notice must be first given to someone of a federal investigation and to preserve documents. This is a very old precedent. That meant the charge must of been under the relatively new untested law of Anticipatory Obstruction of Justice which was passed in 2006 after Enron got away by shredding all those documents before they were under investigation.

The law reads

  • Whoever knowingly alters, destroys, mutilates, conceals, covers up, falsifies, or makes a false entry in any record, document, or tangible object with the intent to impede, obstruct, or influence the investigation or proper administration of any matter within the jurisdiction of any department or agency of the United States or any case filed under title 11, or in relation to or contemplation of any such matter or case, shall be fined under this tide, imprisoned not more than 20 years, or both.

    By literally any agency they meant it, some dude out fishing got charged under the law when he threw illegal catch overboard in sight of a federal wildlife officer, the fish was considered a tangible object by the prosecution. The court ruled that a fish was not.

Unfortunately saved pictures are for me. I was convicted at trial, appealed on void for vagueness grounds which I think is right from my attempt to be as unbiased and analytical as possible reading of the caselaw. to the appeals court upheld it on shaky grounds imo.

So if this person was ordered by Clinton, or flips on Clinton at a trial because they were deleting files in anticipation my case which is currently the highest court decision on the caselaw would be a large influence on the Supreme Court.
