You have to be over 50 years old to get a court approved settlement of your claim in WA. The other option if you do not want to go through a retraining plan is to select Option 2, which will get you nine months of time loss paid out and the flexibility to then use the retraining money on your own without working with a voc counselor. More information about the two options once you've been found eligible for retraining is online here https://lni.wa.gov/claims/for-workers/getting-back-to-work/training-options. If you take Option 2, your claim will then close and you'll also get paid out the award for whatever your PPD has been rated at.

Don't let your attorney make the decision about what is right for you here, but definitely talk to them about how to best help you move on with your life. It is common for attorneys in WA will take a portion of your biweekly time loss checks, and if that is the case for you then keep in mind that it is then in their best interest to keep you on time loss as long as possible which is why a lot of them will encourage people to go through with an LNI approved training plan.
