I think you answered your own question. It’s not about not having the laws in place to punish these dorks (we do), but rather that the law isn’t applied equally.

Harsh sentences are handed down for nonviolent offenses by the disenfranchised, but for others they can expect a slap on the wrist. Even if mandatory minimums were in place for this offense, you’d see it being applied full force to POC participating in legitimate protests, and these cosplay insurrectionists would just be getting plea deals that circumvent any mandatory minimums anyways.

Any new laws created out of a reaction to Jan 6th will only backfire imo. Given what we know about how the laws are applied, it must be assumed that any application will disproportionately and unjustly impact POC.
