You guys need to realize the cops are still wondering WTF is going on. All they see is chaos and a dude with a pistol and when asked to drop it gets all weird and yells ask my mom! the cops aren't going to ask his mom first if he is innocent and not a threat. They just react to the perceived threat. His partner was like 1ft away from the gun making it worse. Could both cops have retreated to cover and then asked him to drop it? Maybe, but unfortunately they didn't. They just chose the easy way of controlling the situation by shooting him and it most likely will be legally justified to be quite honest.
