Let's not jump the gun on not being able to file Bankruptcy. If you file CH13, you can repay the amount over the exemption amount to keep your home. For example.

Let's say your home is worth 100k and you have a 30k mortgage, giving you 70k equity.

You can exempt (federal exemption) 46k of your home equity. The other 24k you can pay over 60 months, or 400 a month to your unsecured creditors. However, you only have 25k in debt, so when you add in other assets you give up, your payment may not even be that high.

Honestly though bud, you probably are not bankrupt. When you say you have to much equity in your home to file bankruptcy under CH7, you do realize that means you have > 46k in equity right? Sorry bud. Sell the freaking house, pay your debt off, and rent an apartment. Here is a list of things id do if I woke up in your shoes.

1) Talk to your wife. Plan on her continuing to work and you staying home with the kid until you get a job. Hurt your masculinity? Hell I know it would mine. GOOD!!!! Use that fire and hurt to get out there and get a good job. Use it to motivate you.

2) Call your creditor(s) and and work something out where if you send them a little money they will leave you alone for a few months.

3) Get your house on the market and sell sell sell with the goal to take home 30k+.

4) Rent an apartment.

5) Find a job.

6) Build a 3-6 months emergency fund.

7) Start saving mad stacks so you don't get in this position again.
