The Question: Did Hillary Flip-Flop on the Bankruptcy Bill? Answer: TL;DR Hillary voted for a version of the bill that included amendments from her and people like Senator Schumer. This version of the bill passed the senate with her vote but died in the house. In the next session of congress the bill came back and she filibustered it with the rest of the party but it was eventually passed. Let's run down the order of events. In the final years of the Clinton administration congress voted to send the bankruptcy bill to the president with a 70 votes. Once it arrived Bill vetoed it at Hillarys insistence and the session of congress ended before they could take it up again. With 70 votes it was pretty likely that they could have overridden the veto if they had been given the chance. In the 107th session of congress the bill was brought up again. In this session Hillary made a tactical choice that she couldn’t stop the bill but that she could use the democratic support it had to pass amendments to improve it. She voted for the version of the bill that contained various amendments and it passed the senate 83-15. This version of the bill was never able to be reconciled with the house and died on the vine. Here she is in her own words, "Many of my colleagues may remember that I was a strong critic of the bill that passed out of the 106th Congress. While we have yet to achieve the kind of bankruptcy reform I believe is possible, I have worked with a number of people to make improvements that bring us closer to our goals, particularly when it comes to child support. ...... Let me be very clear—I will not vote for final passage of this bill if it comes back from conference if these kind of reforms are missing. I am voting for this legislation because it is a work in progress, and it is making progress towards reform”. After the 2004 elections republicans gained the majority of seats in the senate. This basically ensured the bill would eventually be passed. When the Bankruptcy bill came up again in the 109th session of congress Clinton voted to add the same amendments that she had voted for in 2001. She was defeated and they were not added to the bill. After the amendments were defeated the democrats including Hillary voted to filibuster the bill. Based on the republican majority in the senate this was easily bypassed. After the bill was reconciled with the house Hillary released a statement that she would not have voted for the bill but that she would not be present as Bill was about to go under heart surgery. The bill eventually passed 74-25 and Hillary's vote would not have changed the situation. She released a statement that is was added to the record that you can read in the sources section. (b) Transition.--Notwithstanding subsection (a), the minimum wage applicable to the Commonwealth of the Northern Mariana Islands under section 6(a)(1) of the Fair Labor Stnadards Act of 1938 (29 U.S.C. 206(a)(1)) shall be-- (1) $3.55 an hour, beginning on the 60th day after the date of enactment of this Act; and (2) increased by $0.50 an hour (or such lesser amount as may be necessary to equal the minimum wage under section 6(a)(1) of such Act), beginning 6 months after the date of enactment of this Act and every 6 months thereafter until the minimum wage applicable to the Commonwealth of the Northern Mariana Islands under this subsection is equal to the minimum wage set forth in such section. ___ I also think it bears mentioning that Warren signed a letter in 2013 asking Hillary to run for president.
