LAOP works for a bar that mandates all employees work a two hour unpaid shift or lose $100 from their paycheck. Sounds like a slam dunk case, except that a former employee already sued them and lost... according to water cooler rumors.

I worked as a KM for a corporate restaurant in ID for awhile. I received some training since I would close out the books sometimes.

From experience, I have never had anyone make a wage complaint. If someone did, I would immediately forward the complaint to HR, and it was up to HR to fix it. My understanding at the time is that servers are supposed to make federal minimum wage for hours worked. It was around $7 at the time. If a server worked 8 hours, then they should be walking out the door with $56 (7 x 8) which includes the paltry server wage.

I haven't worked in the restaurant industry for awhile, but not paying server wage for two hours wouldn't effect anything since the server is making more than minimum wage per shift.

IANAL, but from my restaurant experience, you can get away with not paying server wage when tip wages are above minimum wage.
