Lawyers of Reddit, what was your “oh shit” moment in court?

The admin side of discovery can get pretty tough when people decide to try and play the “I found this and brought it to court last minute!” Or “I was never given any discovery for this case!” game.

The entry level position in my field is a discovery admin, so dispersing discovery to parties was my entire job for a time.

We had so many attorneys try and pull Shit like this (claiming they never received anything, bringing things of their own that opposing counsel was never given) that we had to get this ridiculous system in place.

Every document had to be sent to every party at the exact same time, in the same email via a secure server. That then gave us a time stamped log of exactly when everyone opened the file, how many times it was accessed, and a receipt for each one that we would keep and submit to court on the day of trial.

“Oh, you never received this psych eval where your client admitted to committing this crime (and comes off as a complete nut)? That’s strange. You downloaded it at 4:30 pm on 8/13/17, and viewed it four times over the next week. Would you like to see the receipt?”

It made you grit your teeth a bit that you had to overdo it so much to keep attorneys honest, but it stopped that behavior RIGHT quick.
