I don't think so. I think that the FBI was being asked to give them to the senate committee. That means someone in the FBI had to make the decision, yes or no, to hand them over. Whoever did it was likely to get the axe from Trump's incoming stooge.

But now there is a special counsel who is heading up a criminal investigation on the subject, and that counsel can (and will) subpoena the FBI for that information. Now rather than one of the high ranking FBI officials (who are likely anti-Trump, pro-Comey) having to sacrifice their career and opening a seat for a new Trump croney by handing over the memo to congress, they can just wait on the subpoena so they can say "I didn't want to, but I was forced to by law."

Does that make sense? I don't think it's going away. I think the FBI is saying that now that this is a criminal investigation, they're going to play by a different rule book and not hand over information without warrants. This technically is a good thing, because if a trial every does come about, it prevents Trump or whoever from having the evidence dismissed as having been acquired inappropriately.

That is my analysis of the situation. But then again, I'm just an arm-chair pundit, so wtf do I know.
